This document details the Terms and Conditions related to the use of this website, our services and information provided by use through this website and via any other means.
For the remainder of this document the terms, “Us”, “Our” and “We” refers to Harmony and Wellbeing Pty Ltd and “You” and “Your” refers to you the customer or visitor to our website.

By using this website and by placing an order through this website you are agreeing to be bound by the terms and conditions outlined in this document and any referenced documents
Changes to the terms
We reserve the right to change, modify, add or remove portions of these terms at any time. If you choose to use this website, place an order, use information provided by us through this website or consume our services then you are stating your agreement, understanding and acceptance of the terms outlined here.
Limitation of liability
You agree that we are not legally responsible or liable for any loss or damage you might suffer related to your use of the website, or information or services provided by us, whether from errors or from omissions in our documents or information, any goods or services we may offer, or from any other event arising from the use of this website.
It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements prior to you purchasing any product or service. You acknowledge that information and materials provided by us may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

You must be over 18 years of age to use this website and to purchase any goods or services
Competition and consumer Act
For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), our liability for any breach of a term of this agreement is limited to: the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.
The use of different couriers may vary from time to time for what ever reason we see fit. Arrangements in place at any point in time will be detailed on our website.
The time to deliver goods may vary between 1 and 14 days from the time of order unless otherwise notified.
Should delivery costs for a particular order exceed the normal expected costs due to the content of the items or particulars of a delivery location then you will be responsible for any additional delivery cost. We reserve the right to hold an order until you have paid any and all relevant delivery costs.
Order fulfillment is processed promptly upon receipt of full payment.
All returns require an approved Return Authority issued by us. You can contact us to ask for a Return Authority by emailing firstname.lastname@example.org and including:
- A description of the issue
- A copy of the original invoice or receipt
- Photo’s of any damage or fault
- Photo’s of any damage to the packaging
If we approve the Return Authority then it will be sent to you via email. Please follow the included instructions and include a copy of the Return Authority with the returned goods.
Faulty and damaged products
If goods are damaged or faulty on arrival then please contact us within 2 business days of the goods arriving. Once this period has elapsed then we cannot claim for damaged goods in transit and the manufacturers warranty will apply for any product faults.
We will in the first instance attempt to repair or replace damaged or faulty items. If an item cannot be repaired, replaced or a suitable alternative product provided then we will provide a refund.
If an item is received that is past it’s Best Before or Used By date and this was not made clear in the sales process, then it may be returned as if it were a damaged or faulty product.
The costs associated with the return of faulty or damaged items will be borne by us but must use the courier or delivery method that we specify with the Return Authority. Upon receipt of the damaged or faulty goods and confirmation by us of the fault or damage, we will refund the courier costs you have incurred by you.
Change of mind
If you change your mind about your purchase and would like to exchange it then please contact us within 14 days of receiving your goods.
Since not all items are re-saleable once they leave our custody, the following items will not be accepted for refund or exchange due to change of mind:
- Food items and items for internal consumption
- Items with damaged packaging.
- Damaged items (not claimed as Faulty and Damaged Goods).
- Items designed for use on the skin, hair or body that have a broken manufacturers seal or no seal at all.
- Items sold at 20% or more off the normal or recommended retail price.
- All items sold past their Best Before date if this has been made clear during the sales process.
Store credit will be provided for items returned with an approved Return Authority and all shipping and delivery costs will be borne by you.
If a product is mis-represented on our web site due to incorrect or misleading product descriptions and details and the mis-representation is clear, unambiguous and contrary to the product that you receive, and the mis-representation material in nature (e.g. the mis-representation impacts the use or intended purpose of the item) then we will provide a refund, exchange or store credit.
Please note however that product images are not a good indication of a product and that the size, shape or colour of the image may appear different on the screens of different devices. In addition cosmetics and hair colouring often appear differently in images than in real life. We will not provide a refund, exchange or store credit for minor differences to the images displayed on the web site if the item has been opened or otherwise damaged.
Allergies, intolerances, sensitivities, medical and health
We provide information on our web site to help you narrow down your choice and make the shopping process easier. By making a purchase you agree and confirm that you have read and understood “Guide To Understanding Icons” and “Important Allergen Information”. If at all in doubt about the ingredients of a particular product then read the manufacturers labels and web site information before using or purchasing products.
A product that aggravates an allergy, intolerance or sensitivity is not necessarily a faulty product unless it contains an ingredient that the manufacturer says it does not. We will not provide refund, exchange or store credit for used items if they aggravate an allergy, sensitivity or intolerance unless they are in some other way faulty.
We explicitly do not warrant the accuracy, currency, correctness or suitability of any information of a health or medical nature including all information regarding intolerances, allergies and sensitivities and information regarding health benefits of products including blog articles, product details, marketing material and all other material.
It is your sole responsibility to ensure that products are fit and suitable for use by you or any person that you supply them to and you completely resolve us of any and all liability arising out of the use of the products information and services to the maximum extent allowable by law.
It is your responsibility to seek suitable professional medical and health advice for all medical and health related issues prior to using any information or product. We expressly recommend against self diagnosis and recommend consulting a suitable health practitioner in all instances.
To the fullest extent permitted by law, Harmony and Wellbeing Pty Ltd absolutely disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for any particular purpose. We give no warranty that the documents, goods or services will be free of errors, or that defects will be corrected, or that our website or its server is free of viruses or any other harmful components.
Whilst we, at all times endeavor to have the most accurate, reliable and up-to-date information on our website, we do not warrant or make any representations regarding the use or the result of the use of any document, product, service, link or information in our website or as to their correctness, suitability, accuracy, reliability, or otherwise.
When you purchase something from our online store, as part of the buying and selling process, we collect the personal information you give us such as your name, address, email address and we record your purchase history. We also gather name, address and contact details from you with consent when you make a purchase from our physical store and also record your purchase history.
With your permission, we may send you correspondence and marketing material about our store, new products and other updates via email or other means.
We may use your personal information to help improve the services that we provide to you and other customers. We will only provide your personal information to third parties where the third party is providing services directly to us under a confidentiality agreement and the sharing of information is necessary to deliver or improve our services. We may also provide your information to the new owners in the event of business acquisition where the information is required by the new business owners in order to continue to provide the services.

Use by competitors
The use of information from our website for purposes that are in direct or indirect competition with us is strictly forbidden. This explicitly excludes the use, sale and promotion of our information, products and services for purposes supporting the sale, use or promotion of products and services that are the same or similar to those provided by us.
We will hold you solely responsible for any loss or damage caused to us and profit or gains made by you or other parties arising from activities involving the use of information from our website.
Trademark and copyright
Harmony and Wellbeing Pty Ltd expressly reserves all copyright and trademark in all documents, information and materials on our website and we reserve the right to take action against you if you breach any of these terms.
This material includes, but is not limited to, the design, layout, look, appearance, trademarks and graphics. You are not permitted to reproduce the documents, information or materials on the website for the purposes of sale or the use by any third party.
You may not, except with our express written permission, distribute or commercially exploit the content.
This agreement and this website are subject to the laws of ACT and Australia. If there is a dispute between you and us that results in litigation then you must submit to the jurisdiction of the courts of ACT.
These terms and conditions represent the complete agreement between you and us concerning your use and access to our website and your use and access to the documents, products and information and our supply of products and services to you. No other term is to be included in this agreement except where it is required to be included by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.
Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.
